Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Maximilian Philipp Hoffmann ("we," "us," or "our") concerning your access to and use of Homie (the "Service"), including our mobile applications for iOS and Android, and our website at https://homie.fentekk.com.

By accessing or using our Service, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use our Service.

Governing Language

The original and legally binding version of these Terms is in English. In the event of any conflict or discrepancy between the English version and any translation, the English version shall prevail and be controlling.

Translations

These Terms may be translated into other languages for your convenience. Any translations are provided as a courtesy only and are not official or legally binding. While we strive to provide accurate translations, we do not guarantee their accuracy or completeness. You acknowledge and agree that your access and use of any translations is at your own risk.

Description of Service

Homie is a household management platform that allows users to create and manage household chores, track shared finances and expenses, create shopping lists, join household groups, and collaborate on household tasks.

The application consists of different features and functionalities that may be changed, extended, shut down, or restricted at any time by Maximilian Philipp Hoffmann without prior notice and without giving reasons.

The Service is provided "as is" and without any warranties. Maximilian Philipp Hoffmann does not guarantee the availability or functioning of the Service. You are at all times responsible for your own data and must not rely solely on the information provided by the Service.

User Requirements

You must be at least 13 years old to use our Service. By using our Service, you confirm that you are authorized to use the application and have the legal capacity to enter into these Terms.

Maximilian Philipp Hoffmann may exclude any user from the use of the Service at any time without notice and without giving reasons.

User Accounts and Registration

To access certain features, you must create an account using email, Google authentication, or Apple authentication. You are responsible for maintaining the confidentiality of your account credentials, all activities under your account, and providing accurate information.

You must immediately notify us of any unauthorized use of your account. We will not be liable for losses caused by unauthorized use.

Subscription and Payment Terms

Homie offers subscription-based premium features with monthly and annual options. Current pricing is displayed in the respective app stores at purchase.

All payments are processed through Apple App Store or Google Play Store. Payment terms and refund policies are governed by the respective app store's terms and conditions.

Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends. New subscribers may be eligible for a 7-day free trial.

You can cancel your subscription through your app store account settings. Refund requests must be made through the app store - we do not process refunds directly.

We use RevenueCat to manage subscriptions and related analytics.

App Store Terms

This Service is distributed through the Apple App Store and Google Play Store. Your use of the Service is also subject to the applicable app store's terms of service:

In case of conflicts between these Terms and the app store terms, the app store terms will prevail for matters related to your relationship with the app store.

User Content and Groups

You retain ownership of content you create but grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for providing and improving our Service.

When you join household groups, you can share content with other members. Important: Group financial tracking and calculations are informal records only and not legally binding. Users are solely responsible for the accuracy of shared information and any financial arrangements between group members.

The Service enables information sharing within groups with no explicit permissions or rules. Maximilian Philipp Hoffmann cannot guarantee that information has been correctly entered or that calculations will be accurate.

Prohibited Uses

Users are strictly prohibited from:

• Using the application for any unlawful purpose or to solicit others to perform unlawful acts
• Violating any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• Infringing upon or violating our intellectual property rights or the intellectual property rights of others
• Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating, or discriminating
• Submitting false or misleading information
• Uploading or transmitting viruses or any other type of malicious code
• Spamming, phishing, phreaking, pretext calling, spidering, crawling, or scraping
• Using the application for any obscene or immoral purpose
• Interfering with or circumventing the security features of the application
• Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the application
• Creating derivative works based on the application
• Using automated tools to extract data or functionality from the application
• Sharing your account credentials with others

These activities may result in immediate account termination.

Third-Party Services

Our Service integrates with various third-party services including app stores, Supabase, AWS SES, PostHog, Sentry, Expo/EAS, Google OAuth, and Apple Sign-In. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party practices.

Intellectual Property Rights

The Service and its content are the exclusive property of Maximilian Philipp Hoffmann and protected by intellectual property laws. Homie and related logos are our trademarks and may not be used without written consent.

You retain ownership of your content but grant us license as described in the User Content section. Any feedback you provide may be used without compensation.

Privacy and Data Protection

Your privacy is governed by our Privacy Policy at https://homie.fentekk.com/privacy, which is incorporated into these Terms. We comply with applicable data protection laws including GDPR for EU users.

Informal Records and Financial Disclaimers

All financial tracking, calculations, and records within Homie are informal and not legally binding. You acknowledge that:

• Financial information accuracy is your sole responsibility
• Calculations are provided for convenience only
• You must not rely solely on our Service for financial obligations
• Financial arrangements between users remain your personal responsibility
• We do not guarantee data accuracy or integrity

No Warranty

The Service is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties including merchantability, fitness for purpose, and availability. We do not guarantee uninterrupted access or error-free operation.

Limitation of Liability

Under no circumstances will Maximilian Philipp Hoffmann be liable for any direct or indirect damages arising from use of the Service, including loss of profits, data, business interruption, or financial losses.

Liability for slight negligence is explicitly excluded. We do not exclude liability for gross negligence or willful misconduct.

Our total liability shall not exceed the amount you paid in the 12 months preceding the claim, or €50 (in words "fifty euro"), whichever is lower.

Indemnification

You agree to indemnify Maximilian Philipp Hoffmann from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, your content, or violation of others' rights.

Termination

You may terminate your account anytime through app settings or by contacting legal@fentekk.com.

We reserve the right to terminate, suspend, or restrict access immediately without notice for violation of Terms, illegal activity, or any other reason we deem appropriate.

Upon termination, your access ceases immediately. We will retain data for a reasonable period before deletion as described in our Privacy Policy.

Governing Law and Jurisdiction

These Terms are governed by German law. Legal proceedings must be brought exclusively in the courts of Munich (München), Germany. EU consumers retain their rights under EU consumer protection laws.

Dispute Resolution

Before formal legal action, contact us at legal@fentekk.com for informal resolution. If unsuccessful, disputes may be resolved through German mediation procedures. EU consumers may access the European Commission's Online Dispute Resolution platform.

Changes to Terms

We may modify these Terms at any time. We will update the "Last Updated" date and notify you through the Service or email. For subscription services, material changes will be communicated at least 30 days in advance.

Continued use after changes constitutes acceptance of new Terms.

Severability Clause

Should individual provisions of these Terms and Conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes as close as possible to the economic purpose of the invalid or unenforceable provision.

The same applies if these Terms and Conditions contain a regulatory gap.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement regarding Service use and supersede all prior agreements.

Waiver

If we fail to exercise or enforce any right or provision of these Terms, it will not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by the relevant party.

Assignment

To the extent permitted by applicable law, these Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Maximilian Philipp Hoffmann without restriction. Any assignment attempted to be made in violation of these Terms shall be void.

Survival

Upon termination of these Terms, any provision which, by its nature or express terms should survive, will survive such termination or expiration, including, but not limited to, provisions relating to intellectual property, privacy, indemnification, limitation of liability, and dispute resolution.
